    Hi,

    i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
    i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

    My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?
    Please Let me know this information.

    If she comes back on H4 she can not start working until another h4-h1 (cos) complete. It is really your personal choice and how confident you are about your wife's successful h1b stamping at home consulate.

    Barring the obvious differences like the larger viewfinder & LCD screen which are good and the frustrating differences such as not being able to re use the batteries from the D70 along with the switch to the SD card. The pleasant surprise comes when setting down to do a post edit after shooting and seeing the improved image quality. The first thing I noticed was the greater detail in the eyes. I've uploaded two images cropped and untouched taken straight from the camera. Both were shot under similar conditions, overcast day, both in a wooded area with trees overhead and a fill flash used in both. The first image is from the D70 and the second is from the D80. This very well could be a battle of the lenses as well, 70-300mm vs the 18-200mm, both Nikkor. Regardless of which is responsible for the improvements I like what I see.

    the testimony links on the right hand site are worth reading they make compelling arguments..wonder what happend..there are no commitee member comments on this hearing.

    Found this while searching the website of the Senate Judiciary committee. Even though it is more than a month old, the references to SKIL bill in the hearing offers a glimmer of hope to us..As I understand the SKIL bill has been referred to the same committee for several months now.

    Gurus,
    My and spouse case have
    Priority Date - March 2004,
    Received Date - July 2nd, 2007
    Notice Date - Aug. 08, 2007

    My Kid's case has
    Priority Date - March 2004,
    Received Date - July 2nd, 2007
    Notice Date - Nov. 20, 2007 (As 08/23/2007 is the current processing time frame, my kid's Notice Date is out of current time frame)

    This is happened due to a rejection of my kid's 485 application initially during July 2007 fiasco due to the Old and New fee schedule implementaion of USCIS, even though we have remitted the correct fee.

    1) Do anybody know how USCIS will process our case?
    Like adjudicating my and spouse applications with out kid's applicaiton? Or none of the applications process?

    2) Taking an info pass appointment will do any favour on this case?

    3) Any other suggestions?

    Friends,

    My EB2 I-140 got approved during 1st week of April and USCIS successfully ported my EB3 priority date of Jan, 2006 to the new EB2 I-140. As per my attorney, interfiling shouldn't be done as I have been with same employer all along and same employer sponsored for my porting. The attorney says, this should be automatically taken care of by USCIS.

    My question is...I couldn't find the proper procedure/documentation for my scenario. Did any body come across this situation and can any one offer any suggestion?

    1) From the day your current one expires


    2) Recent court ruling is that even if it is beyond 240 days from day your current one expires, your status is valid as you are waiting for decision. You can search for this, I read it couple of months back. Or seniors may confirm this.

    We are all retrogressed people here and may not have the experience in this matter. Immigrationportal.com has an area to discuss such posts. You may want to discuss there.
    In my experience in such matters, it is really not helpful to post qualifications and ask for chances of success. You need to discuss everything with an immigration lawyer since it is a highly difficult catagory for anyone. There are several finer details in each of the criterias that regular members do not know on forums.

    I believe job description is important, not title. As discussed earlier threads, in most Financial companies software programmers have AVP or VP title. That should not matter as long as job responsibilities are same.

    Yes , I did extension for H4 to avoid out of status. But that will automatically override her approved H1 to h4.(The latest one is valid). But when ever she is ready to work, (in her case she is pregnant and planning to work from next year only) her employer has to change the H4 to h1b(COS). There is premium processing and it would take only 15 days. No need to apply for a fresh H1b.

    hey bharti. dont get upset by my comment,don't quit !! i'm not a design student as well, but there are plenty of articles and tutorials in the net (like kirupa for example) where y can find lots of resources and learn different interesting things!

    It's not so easy to be a designer, but it's not impossible and u must never quit!!1:P)

    Possibly, USCIS will ask for your updated employment contract and job description. RFE is usually sent to your lawyer.

    I don't know why they split your wife's application. Did you marry after you applied for GC?

    Hi,

    I filed my 485 in Dec 2004.My PD is June 2004.
    Got married in 2005.

    If (Less Probability..) i get my 485 approved and not able to add my Spouse's to my 485.

    What would be my Options.

    Please advice.

    WILL DOS or USCIS release 750 new quotas for the Q1 of 2011 in the Oct VB? or just 250 new quota for Oct? then 250 for Nov and Dec?

    Nothing is certain man..
    Anything can happen.
    Dates might retro.
    Dates can move 20 days to May 28 2010.
    Dates can move two months to July 1st.

    It is a guessing game. No one can predict. Why? because the data given to us is not fool proof.

    Democrats are usually pro illegal immigrants since they would be getting more votes by legalizing illegals. Republicans are more pro business and hece are usually more open to legal immigrants but even they seem to be taken over by anti-immigrant hard core conservatives these days.

    Of course nut jobs like Tom Tancredo (R- CO) will do more harm by projecting legal immigrants as American job exploiters along with racist organizations such as NumbersUSA.
