They consented to me retaining their data when they didn't block their number before calling. Which is possible and an option. There was no option for this "tracking list" other than a stupid TOS that you can't op out of partially.

Yeah sure, a business tablet with a screen too small to type on. Rim's marketing for this thing seems to be all over the place, they say business tablet, but the picture shows Need For Speed?
Out of the 7" tablets the playbook looks the best, but it is still a 7" tablet. Combined with it's wider display the keyboard will be way to small. If they come out with some kind of awesome keyboard accessory then it may stand a chance. BB's success had a lot to do with its comfortable keyboard.

I read over at TechCrunch that it was to meet daily sales quotas, which is to benefit the store manager, mostly. They look better for hitting/beating their quota everyday, regardless of whether or not it is actually at all helpful to Best Buy.
So it sounds like Best Buy has stolen a page from communist China's playbook. That seems like good business practice.
And why would it be an accomplishment for a manager to sell the quota of ipads for the day? You could set up a shop that exclusively sells ipads in the depths of a cave inhabited by a fire breathing dragon and you'd still have fanboys lining up at 6am to get one.

They don't need to amend. This is a federal pleading so the standard is whether it puts Samsung on notice. This is a different standard than state courts, where they would have to be much more specific. Eventually they will have to prove which models are accused. Looks to me like the complaint is fine.
So all that is left is to discuss the actual merit of the trade dress claim, of course, something that will in the end be up to the judge.
We can use pictures all we want, something tells me Samsung is just going to bring in devices into the courtroom. Pictures can be misleading as certain angles/shots might make ressemblances show up that aren't quite there.
Also, it remains to be seen how much the judge will accept generic things like "rounded corner", since I don't think I've ever had a phone without rounded corners and how much in the end, he decides that the devices to ressemble or not each other.

Thinking it's only stored on the device and not used by Apple is naive. What's the point of logging your every location if it's not going to be used in some way.
When you bought your device (even if you didn't purchase one, I'm speaking to the general 'you'), you knew that it had GPS capabilities. You knew that the phone knew where you were at any given time.
You also knew it had network capabilities. Nothing stops any GPS device with networking capabilities from broadcasting this data without you knowing. We trust the manufacturers of these devices to not do that.
Saying you don't trust Apple/Google/etc to not secretly broadcast your data just because it's backed up like your contacts/phone-conversation-information/texts/etc runs counter to the same trust you placed in those companies when you bought the device; if they're willing to broadcast that data because it's saved on your device they could just as easily broadcast that data as it's being gathered, real time without storing it. In fact, it'd be easier to do that since there wouldn't be an easy artifact left behind for people to gawk at.

On the iPad or Mac, whatever you're doing you'll be able to pinch your 5 fingers together (or press the home button on iPad or iPhone) and it'll bring up your apps so you can launch something else. It's just a consistency thing.
He was being that literal: "Step 2 may very well be the one & only Apple OS - based on iOS." This is absurd. Obviously OS X is taking cues from iOS. As you say, they've said so. But that's all that they are doing.
Well, cues in the interface, and the same underlying OS. That's all it is for now. Mac OSX has a lot of extra options.
(Now, might a Mac at some point use iOS in some way? Sure. Imagine a trackpad that was basically an iPod touch, or being able to fold our MacBook screens flat, which would boot iOS and turn it into an iPad. I'm sure Apple has some interesting things cooking in their labs. But OS X as we know it isn't disappearing.)
There's a group of doom and gloom people on these boards that believe OS X will go away and we'll have one OS which we'll poking at our screens with no access to the underlying file system and we'll have to start jailbreaking our Macs. This line of thinking is idiotic.
iOS has to grow up, especially with respect to File Management. I think iOS 5 will go a long way in this area.
Once we get to iOS 6 I think we may start seeing iOS as the default Mac OS, with an optional OSX install (like X11 is) that extends it to do everything we expect from OSX (access to the file systems etc., perhaps even required for installation of non-app store programs). It may even be something where someone with "administrator" privileges gets the OSX add ons, while standard users do not.

Are you serious? The Moto Droid (i.e.: the original one) is slower than molasses. You cannot be talking about the original Verizon Droid. That phone under-delivered out the gate. My friend from work whose entire family uses Verizon bought a Motorola Droid and she thought she was getting the equivalent of an iPhone and hated it ever since. She was jumping up and down when Verizon got the iPhone.

The Cell phone market is very fluid and Apple knows it just has to keep producing the coolest and more desired phone and they will always have a decent share of the market and make tons of money.
in the mean time, Moto, Samsung, HTC, LG and others all battle it out with the same OS and dropping prices to get market share. A race to the bottom strategy that I'm not sure will last forever.
All Apple needs to do is keep the "coolness" coming. Reward us with nice iOS updates and keep us happy with the best support in the market.

Problem is, its still Final Cut and will still suck at managing media.I work in all three worlds with NLE (Avid, Apple & Adobe). If your know what your doing, then Media Management should be as easy as pie. Now do you have something specific that irks you about FCP? For starters I instruct at a local college in the evenings. I first burn it in my students heads that they need to use an separate drive for this app.

Also, I'm waiting for the RED Scarlet camera to hit the market, and have heard speculation that RED and Apple will release a new highly efficient compression codec based on RED's Redcode called REDRay.
The speculation is that REDRay will be used for everything from 4K DCP playback in movie theaters to a download/streaming version that will be usable for buying up to 4K movies through iTunes.
RED hired plugin developer Graeme Nattress awhile ago and he has been pushing the REDcode science forward with excellent results.
