Republican Presidential candidate Newt Gingrich continues to stake out his claim as the sole moderate on immigration in the GOP campaign. Politico reports that he is in favor of a legalization program that will allow "citizen boards" (similar to the draft boards of an earlier era) to determine whether undocumented immigrants deserve to stay in the US. He explicitly rejected a path to legalization. I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

Got an RFE to produce employment verification letter from my current employer. Yes, i changed the employer recently but didn't file AC-21.
Do you know how long USCIS takes to update the status online?

I am assuming that your lawyer sent it by some means that can verify that it was delivered.
USCIS usually takes about 7-10 days to update it online. (for example, if your RFE response was delivered to USCIS on Aug 10, expect it to be updated around Aug 17-20).
If you do not see update after 15 days of the delivery of the RFE response, call USCIS customer service so they can track it for you.

We had the same thing happen for our AP application. I recently saw that document mailed on the 17th. They processed both our cases at the same time. if I were you, I wouldnt worry. I had efiled on June 18.

I am married to a US citizen - married since 10/23/04 - we have lived in the US before where I obtained a conditional green card : given 01/17/06 expired 01/17/08. We left the US in may of 07 to live in denmark (my home country) and thought the conditional green card was "gone" when it expired and did not apply to remove conditions in time.
In 2009 we decided to return to the states - I came here 10/16/09 on a visa waiver. In december 09 we filed i130 and in march i485 thinking we had to start over on the process of getting a green card.
April 8th -10 we recieved a denial letter saying:
"A review of agency records indicates that the beneficiary has already aquired lawful permanent resident status on january 17 2006 through other means"
" therefore , the beneficiary is not eligible for the benefit sought and this additional petition is denied"
" This denial will have no adverse effect on the lawful permanent residence status that the beneficiary has previously aquired"
Attached to the letter is an appeal form.
So my query now is: since they already consider me a lawful permanent resident according to that letter - how do I go about getting my green card? and what happens to the i485 that they still have in initial review?
My husband and I are very confused about all this - we were told we had to reapply so we are puzzled about that denial letter. Customer service at uscis only reiterates the content of their website and we cannot get through to anyone that can shed any light on this. Infopass is not available in our area either, so I turned to this forum.
Than you so much for your time in considering this matter and for any information you might have for us.

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

Bob is right. Don't buy anything from any camera shop in Brooklyn. Those package deals are not deals at all. They are a huge scam designed to steal your hard earned $ and leave you so frustrated at their total lack of customer service that you give up. I have a question about multiple 485 filings.
My PD was Eb3 May 2002 and I filed my 485 last week. My wife was added to the application as well.
Now my wife's PD is current and her date is EB3 Jan 2006. Can we file her 485again and add me again as her dependent.
Attorney says no but I am not sure if I can believe them. Besides there is a risk of not filing again for her seperately as in the future the dates may retrogress. I would prefer that both of us have independent applications in as well so we can both fall back on each others application if the need arises.
Is any one else in my shoes and knows the answer
