On Sept. 14, President Bush signed the Honest Leadership and Open Government Act of 2007, an ethics and lobbying reform bill, which enforces a number of new restrictions.
Under the new law, lobbyists are prohibited from providing gifts, food, beverage and travel to Members of Congress, their staff or employees. A violation of this law could result in civil fines and/or criminal prosecution for the Company and individuals involved.

does your I-140 have an A#? (the newer ones, issued in the last few months) do. If so, you can try sending the inital-evidence with a note asking them to ti tie to your 485 case, mentioning the A#. If you dont have A# ask your lawyer whats the best way out (name+DOB+??).
Keep a copy of your tracking number/fedex signature proof of whatever you send.

Hello,
First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?

You will have to redo your LC, I 140 and I 485. But you can port your priority date from the earlier application.

Well, I work for a home builder. Mechanics liens have become very common these days. Please make sure that you have an attorney who can really go through all the paper work. Its very important in such a very volatile home building industry. The title company can run a title search or a lien search on the property to make sure that there are no liens on the property at the time of closing.
Be Careful now than sorry later. If they lien your home even the law cannot help you!

Not to scare you but even part-time job in other fields can be a potential issue. Please confirm with attorney though.
I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

I had F1 visa from July 2002 - July 2007 stamped in my passport. I moved to H1b in Oct 2004 and stamped my H1 Visa in June 2005. So you can move to H1B from F1 without stamping any visa only if you have to leave US then you need to get the new H1 stamp before re-entering. Also do not forget to fax a caopy of your H1 approval notice to your school's international center so that they can stop reporting you in SEVIS

Thanks for that link. It is good to know that there is a possibility that I-140 PP may come back in the near future, even if in phases.
One comforting factor here is the extra $1000 is big money for no extra work which is very tempting to USCIS. So everyone knew they would bring it back as soon as the load became manageable, but the big question was when would the load become manageable.

Could you change the flashplayer to something else that has forward/rewind controls. I closed the website a few times accidentally and I had to start all over again as this has no forward buttons.
Secondly, does anyone have access to AILA ? There is a mention of procedures to correct improper rejections by the service centers for cases with incorrect date stamps, lost checks or documents due to the errors on part of service center. I am badly in need of these procedures because I need to know what actions my attorney can take to fix my rejection issue. And I am sure there are many more in the same boat looking for this information.

I received my original I 485 receipt on which my receipt date is - July 10 2007 and Notice Date is - Sep 12 2007 from CSC(even though I applied to NSC)
After one week I have received Transfer Notice from CSC on which receipt date is - Sep 12 2007 and Notice Date is- Sep 17 2007 saying that my case is transferred to NSC
Now I am confused,
Which one should I consider as actual I 485 receipt date
July 10th (Original Receipt Receive Date) or Sep 12th (Transfer Notice Receive Date)

I have couple of questions regarding timeperiod for which I can stay outside US while my I-485 is pending . I had to undergo a re-do surgery of my back in India and was adviced complete bed rest till it heals due to which I am outside US since Jan ending till date
1) Will it effect my GC application as some say its not good to stay more than 180 days outside US continously.
NO, IT SHOULD HAVE NO EFFECT. THE 180 DAY RULE IS MORE RELEVANT AFTER YOU BECOME A PERMANENT RESIDENT. IN THAT CASE IT IS BETTER NOR TO STAY OUTSIDE THE US FOR 180 DAYS.

IT MIGHT. I RECOMMEND CARRYING A LETTER FROM THE H-1B EMPLOYER CONFIRMING THAT YOUR JOB IS STILL OPEN FOR YOU.

This is a simple and straightforward case.
Rules are: You are allowed to change the company but you should be in "same or similar" position.
Your new company will have to agree to continue to support the existing green card process i.e. they may have to give employment verification letter if and when asked by USCIS..
All in all I think you are in the safe..

I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?
Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.
Let me give my case background in details.
* LC applied in oct'07
* I-140 applied in May'08 after LC approval
* 6th yr on H1 ended in June 08
* had to return India since my LC < 1 yr and I-140 was not approved
* Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
