I am unable to determine if the 180 day timeline is calculated from RD or ND? There are different opinions here in this forum and no clear answer. Is there a law text that defines this clearly...does anybody know?

I don't know if this is already posted... Here is my situation...
I had applied for 485 in July with Future Employer in EB3.
After 6 months, I want to port the application to my existing employer. At that time, is it possible to convert the application from EB3 to EB2 using AC21 portability??

Hello guys,
If the employer is not willing to share your I-140 approval status with you, is there a way to find out this information from other sources?
I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.
Thanks for help in advance.
post the employer name and address so that other people will be careful working for him and also if employer comes to know about IV, he will stop these kind of things

I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

My friend has a question. His wifes H1 got approved. As of now she doesnt have job. What if she gets job in dec/Jan. There wont be any pay roll for october and november. Will this create any problem at the time of visa stamping in India if she goes for vaction later in next year.

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?

As per my knowledge you do not need a transit visa for Dubai and Abu Dhabi. I traveled to India recently through Abu Dhabi and did not need one.

I am involved myself in a mess regardning the Green Card labor process
1) I had appplied for RIR labor in Apr 2004 and it was sitting in the Backlog elimination center (BEC)
2) In November 2006 I filed a conversion case and reapplied in PERM on my own while retaining priority date of april 2004.
3) Just last week I got a denial letter from DOL stating the reason
"The employer has not indicated on the application that applicants with any suitable combination training or experience are acceptable. the ETA form 9089 indicates the alien is currently employed by petioning employer and only qualifies for position identified in the application by virtue of the employers alternative experience requirement"
also the letter said
The job requirements did not exactly match the earlier case and hence priority date cannot be maintained
This denial also caused the automatic withdrawal of my earlier backlog case.
4) The priority date was very impt to me since I applied in EB3 and from India.
Is there anything I can do to maintain my priority date. I am also ready to forego the PERM application completely if only I could reinstate the earlier BEC labor case and just wait it out. I understand I commited a blunder by taking the risk of re filing in PERM while maintaining priority date...I feel i am losing almost 3 yrs of wait time and will be relegated to the back of the queue if I refile again

I am in the same situation, I called my lawyer and he mentioned that there is no problem legally, but the issue is incase they need some clarification from you and you are not in US then it would be an issue as the time frame is very short.
I am going to canada for my stamping, so he said it might not be an issue.

I assume you are planning on working in Canada using visitor visa. This is not legal and if you want to do it anyway, immigration authorities would question your intent of travel every monday to friday, when you have a valid H-1B work permit in USA. I don't think you will get by this.
My cousin had a similar experience he worked in Canada for two months on visitor visa, Immigration authorities were tough on him when he was on his way back to USA, asking him how come he had such a big vacation in a calendar year and also various other tough questions.
My advice is to apply for work permit in Canada through your existing companies branches in Canada and then work in Canada as you have suggested.
Please don't follow my advice blindly, contact your Attorney and look at all the legal ramifications and then decide about your future course of action.

I like to change my employer with my pending labor with my current employer. Last year my current employer did 1 yr extension based on pending labor. Still my current employer didn't receive 45 days Notice. But I don't have any info. about my labor. I know only priority date and USPS mail confirmation (when it reached labor dept). I sent 2 mail to H1B7YR@PHI.DFLC.US to get screen shot. But i didn't get any response.
Can you pls help is there any other source to get Labor info.? Since without this labor info. my new employer can't transfer my H1B.

If you are e-filing, answer to Q 15 is not mandatory, so I guess if in doubt it's safe to skip it.

I need help on my I485 pending case:
When I was a PHD student I filled NIW (national interest waiver) and got my I-140 approval (priority date is 6/22/2006). Now I am working for a Telecommunication company.
My NIW I-140 form stated my job is:
SOC Code: 17-2112
Nontechnical description of job: Operations research and logistics with optimization and numerical analysis.
In my NIW cover letter, I stated my contribution in airline industry with the operations research and optimization knowledge. My current work is still related to the operations research and logistics but my contribution is different now. Does that mean I am not in the same research/work field? Some attorney said my I-485 will most probably be denied because I am not benefit to airline industry now. Is this true?
What is the definition of the same/similar field? I thought I should be safe as long as I continue to work on OR and logistics related work, even if my work on different project or for different companies.

An attorney suggested me to apply a PERM as a backup to keep the existing priority date (6/22/06), in case my NIW-based 485 case has any issue.

I'm not from India but I believe in Karma. We create our own future through our actions. If we perform a good action today we can expect a good result. That is why it is so important that the undecided people attend the rally!
Think of retrogression as Sansara. A vicious circle. It is only by acting and creating our own Karma that we will get out of Maya and see reality. Our gren cards will not fall from the sky, we have to go get them! By not going to Washington and assuming that your green card will suddenly appear out of nowhere, you are proving to yourself that you are stuck in some sort of immigration avidya.
We need to act with selflessness as in Karma Yoga, so that we can understand how our unity will bring the results we seek, to all of us.
Remember Arjuna when he realizes before the battle that his enemies are his own family. We at IV should not be our own enemies by not attending the rally, because we all know what Krishna told Arjuna: "Your duty is to fight"
Instead of hurting each other, we need to use karma and our friendship for each other to unite in our common cause and fight. Remember, our duty is to fight, it is our choice then to fight against each other (by not attending the rally and letting others do it) or fight all together, united against retrogression, and create the good Karma that will ultimately defeat the broken immigration system.
We all are family! Let's fight together friends!!! Come JOIN US IN DC!!!!
