Your lawyer is very much on the point, H1B is valid only with the Job. Either H1B COS or H1B stamp outside US, you should have the Job offer in Hand, to be on H1B status.

Can't avoid anything that future hold for you.
1. It would be good if the employer does not let USCIS know about your layoff.
2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

In my employer company (NJ based, desi consulting company) about 50% of the EB-2 PERM applications are under audit.
I need to file my application for EB-2 and I called them. (I have a EB-3 approved labor, on which my employer has filed I-140)
The paralegal advised me that they have stopped filing PERM applications since this month March 2008, hoping that there would be change of PERM processing or application change.
Does any one have any info about PERM change process? Please advise. Thanks in advance.

The first I -797 notice that I got, states that they received my I-485 application on July 16, 2007. On the website for USCIS status update, it states that they received my application on September 8, 2007.
According to my understanding, one does not have to submit the $340 application fee for a work permit if they received the notice AFTER July 30, 2007. This is where it gets confusing.
Here's the problem...if they say on my paper notice that they received the application on July 16, 2007, then I would have to pay the $340.00 - correct?
But if the website states that they received it on September 8, 2007, then I would not have to pay the fee.
I need a job, plain and simple. I have been in this country for 6 years and have not had a single paycheck. I get room and board for taking care of an elderly disabled person and that's it. Any money I do get is from the kindness of friends and family or maybe babysitting for a friend etc.
I cannot afford the fee, but I don't want to take the time to fill out and submit the application if I have to pay.
How do I determine which notice to follow? Should I assume I have to pay the $340 and try to do so by borrowing the money from someone and if it wasn't necessary will they give it back? Or do I just go ahead and submit the application without the money and hope it gets approved? Does a work permit usually get approved or am I wasting my time?
If it is approved, do I get a social security number or what? I can't open a bank account nor change my driver's license without a social security number so I'm feeling really stuck.
Any suggestions?

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

I've filed for the I-140 with EB-1 category in business, then additional evidence was requested and finally received a denial. I would like to know:
1. What are the chances to get approved after appealing?
2. If I were to appeal can I present new evidence?
3. After filing the appeal, how long should I expect to receive an answer from DC office?
4. If I ask for additional time before appealing, what are the chances that the additional time will be approved?
5. Is it better to appeal or to request a motion to reopen whenever I gather the new info to defend my case?
6. Do I have better chances if I skip both appealing and motion to reopen and focus on re filing a new case?

In a letter to Senator Grassley, the CIS defended their H-1B adjudication practices and their everything under the kitchen sink Request for Evidences.
The CIS is looking into revising the form I-129 to have Petitioner and beneficiary both attest that:
The beneficiary has been advised of the offsite placement and accepts the terms of the H-IB employment, including the job location and possible relocation;
Really? Does anyone working for the software industry not know that they have to work off site. These people are always traveling, the beneficiary KNOWS they have to work off site. Same with Oil Company Engineers. Its the nature of their work. Does CIS seriously think the beneficiary does not know?
2. Placement of the beneficiary offsite during the period of employment will be in compliance with the statutory and regulatory requirements of the H-IB nonimmigrant classification;
3. The beneficiary will be paid the prevailing rate of pay at any offsite
location; and,
This is in line with the question on the I-94 application on the plane, "Are you a terrorist." Has anyone ever answered yes to that question? Similarly, will anyone filing an H-1B petition ever say they will not comply with the law?
4. The work itinerary is attached.
The H-1B is given for 3 years. It is difficult to predict the itinerary for all those 3 years. If the work itinerary is for less than 3 years, then the employer has to file the whole H-1B again, with the high fees. And even if they have the work itinerary, the job may be canceled, etc. So what is the point of private employers filing job itineraries with the Government?
All of this simply penalizes the small employers who form the backbone of the American economy.

Thanks! And yes, those were taken in New York. Brooklyn, to be exact...
The first one is the 7th Avenue stop on F. That's actually 8th Ave, but the station is really big. :) The other ones are also of 8th Ave and taken from my apartment.
