Q6: What happens if an application is filed at the wrong Service Center?
A6. Forms I-485 should be filed at either the Texas or Nebraska Service Centers. However, through August 17, 2007 only, employment-based adjustment applications filed at the California and Vermont Service Centers will not be rejected and will be relocated to the appropriate Service Center. Filing at the wrong location could result in processing delays.

I think you'll only lose 1-2 weeks as far as your RD is concered..

I have a 4 year college degree from the US and 5 years of experience. I would like to know when they say 5 years of progressive experience does also that include an increase in salary over the five years? My previous employer paid me 60kper anum but my new employer is paying me 55k per anum. There is drop in salary by 5 thousand. Will this affect my application. Please advise. Thanks much!

I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?

Currently you are on H4. If you apply for H4 to H1 transfer, you can get H1 and start working from October this year. If you cannot find project immediately, you wait up to 3 months or 6 month (maximum), otherwise change status back to H4 or you will be in trouble. Since economy is not good, it is tough to get projects nowadays, already current H1 holders are looking for projects and some have gone back. if you have already worked in India, then you may get project easily, If you did not work, then it is tough to get a project. When you are on H4, you can have peaceful life while your psouse is working, you can have get togethers whenever you want, you can cook special dishes for your spouse and wait at the door in the evenings.Real problem arises when you become pregnant (assuming you are woman), you need to take a long break if you are working,, especially if you are away from your spouse....so point is have fun with spouse, have get togethers with other couples, go shopping at BedBathandBeyond/walmart/target/jcpenny in discount seasons, have honeymoon trips again n again...Go to India whenever you want.These things are so memorable than struggling to get projects and maintaining status. My husband is currently employed on a H1 visa and I am on a H4 visa. Our current visas(H1 and H4) are valid till January 2013. We are Candadian permanent residents who plan on ultimately applying for green cards and settling down in the US. I am a newbie in this arena and have a few questions that I tried searching answers for but couldn't find anything conclusive and would appreciate any answers
1) For various reasons can I stay back in the country for 4-6 months, while my husband goes back to Canada on the extended unpaid leave for the 4-6 months and comes back? Or if I leave with him now, can I come back after 6 months and stay here for 4-6 months? Are there any rules/regulations that prevent me from doing this. Please note that we live across the border in Canada and travel back/forth via car.
2) My hubby is planning on taking an extended unpaid leave from work( for personal and not health related reasons) and his employer is OK with that. This could be as short as 3 months and could be as long as a year. During this time we will be going back to Canada. Do you know if this will create any issues with immigration currently or in the future? How long can this leave exist?
3) If my husband ultimately comes back to a different job after this unpaid leave, will his chances of getting a visa for that new job be affected?
4) If he wants to take an extended leave do we need to leave the country? Can we take an extended leave and stay in the country? Will we be violating any rules/regulations if we do that?
5) Lets say we want to come back after 6 months, do we need to come back together?
6) If we are in Canada for the next 6 months, can we keep taking weekend trips to visit our families in US?

"home", "about" and "services" all link back to index, no content, no details about who is behind this, the examples provided in "portfolio" are not even clickable, and worst, the mail link doesn't work from index.html as it's misconfigured (emailto instead of mailto..), only from the portfolio page, but on this page, the link on the portfolio menu is wrong,
basically, you better hurry and get that site done if you're looking for jobs...

Guys,
My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).
1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?
What type of documents, forms are involved ?
The reason for this post is I was given conflicting info by my old lawyer.

Your wife should take an appointment at the closest US Consulate. She and you should then look up the list of documents needed on the website of that US Consulate.
thats how I did it for my wife but she was from India.

Unfortunately, I don't think it is possible to customize the scrollbar inside a WebBrowser. The WebBrowser is almost a direct inline view of the IE browser, so if your IE browser's scrollbars were different, then I believe the WebBrowser control's scrollbars would be different as well.
In other words, the style is inherited from IE.

Hi,
At present I am on H4 but my H4 expired in December2006. But I have I-94 valid till 2009. My husband also got extension till April2009. Now I want to apply for H1 in April2007. I want to know whether this will affect my H1 approval? Do I need to have stamped H4 which is valid till 2009 before filing fresh H1?
I need this as soon as possible.

I had to withdraw my application since I had to file for a divorce. I was just told yesterday that my petition in withdrawn and my wife will be notified in a week. I was also told that I can re-file before.
Currently we have withdrawn the Divorce papers as well. But I don't know what steps to be taken for re-file.
She has an A number which I can provide now. But the two question I have is her current USCIS status? She came on K1 and another question is "Have you ever applied for Perm. Res.?" The Answer will be yes with date and place of filing, but what should I write for final disposition.
Please help this is urgent.

DMV has accepted EAD with Last name as LNU though the passport do not have any surname . They have issue DL with LNU. Life is moving on.
When I checked with My lawyer about "How to correct at 485 filing" . My lawyer belongs to one of the big corporate lawyer firm (USABAL)
1) correct the name at password . we can send the passport for name split .
if you do not have this isse then ignore
2) Wait for GC CARD
3) File some kind of form to get the replacement card --(we need to attach some proof with form) . Lawyer is going to file for us.
For now just waiting ...

My mother-in-law would like to get visitor visa.
How do I answer #37 of the DS-156?
The applicant's (my mother-in-law) son( my husband) is in the U.S. illegally. I am US cit. and my husband needs to report to visa interview within the next year. We have been post-poning due to medical issues. In the meanwhile we hope my mother-in-law can come here to visit her granddaughter.( I am unable to travel). #37 of the DS-156 asks if any body is in US. We should answer YES, because her son is here, BUT, what do we put for his status? Illegal? I read one article that stated to mark YES only if he has legal status. I do not want to put NO, immigration already knows he is here and we do not want to be dishonest.
Any ideas?

We filed 485 on Jul 2nd. So far no receipt yet.:(
My wife's F1 status is going to expire in Aug. She needs to change her status to H4 now. Will the status change have any negative influence on our 485 application? Do we need to send some amendment regarding the COS?
Btw, which center she needs to send COS this time?:D :D Thanks a lot.
